Refunds ISRAEL

IMPORTANT NOTE

Refund due to covid19 cancellation :

As you are aware, due to Covid-19 pandemic, Iberia was forced to cancel flights to and from Israel.

Where a flight has been cancelled and a refund is due to passengers, it remains the position that it is the agents responsibility to process the refund due  to passengers. If you have not already done so, in accordance with local regulations and laws, please action the refund in relation to flights Iberia have cancelled to/from Israel for the period of 1 March – 30 November 2020.

Before actioning any PNR changes that fall under the Israel Consumer Protection Law, please follow the steps below for GDS or NDC bookings in order to avoid receiving an ADM. There are 3 parts to this process (GDS bookings, NDC booking and the actual law text).

Part 1 – GDS bookings

How to apply for a Consumer Law Refund (GDS Bookings on IB 075 paper)?

If the date criteria comply with the Israel Consumer Protection Law (see law text clauses 1 & 2 below), you can self-managed the refund in your GDS by adhering to the endorsement entries and process below.

Please be aware that it is your responsibility to check the date criteria and their compliance.

Note for refund requests for reissued tickets: both the reissue date and the refund date must fall within the date criteria of the law.

2.

All Refund applications require a passenger category endorsement text and if the relevant endorsement text is missing, and ADM will be issued.

Refunds ISRAEL

Select from one of the below endorsements.

• Individual passenger endorsement text:  ILCL

• Passenger Senior Citizen 65 years or over endorsement text: DOB dd/mm/yyyy ILCL (where dd/mm/yyyy = senior citizen date of birth)

• Passenger with disability endorsement text: Disability ILCL

• Passenger new immigrant endorsement text: Immigrant ILCL

Refunds ISRAEL

Iberia audit team have the right to request at any time supporting proof of passenger category type which you need to supply to them upon request:

• Individual passenger: not applicable

• Senior citizen 65years or over: state-issued document providing confirmation as senior citizen

• Disabled:  a document attesting to the passenger's being disabled for a period exceeding six months, issued by an agency duly authorized by law to establish the existence of said disability

• New Immigrant: an Immigrant Certificate or other certificate of entitlement as an immigrant

Part 2 – NDC bookings

How to apply for consumer law refund (NDC Bookings on IB 075 paper)?

If the date criteria comply with the Israel Consumer Protection Law (see law text clauses 1 & 2 below), please call IB Trade Support.

Refunds ISRAEL

Please be aware that it is your responsibility to check the date criteria and their compliance.

1.

IB Trade Support will carry out the cancellation and add an OP field to keep the PNR live (eg. OP23MAY/ILCL RFND).

2.

On the same day as the cancellation, please send an email in English language to CallBA.tradehelpdesk@ba.com  confirming which passengers have cancelled under ILCL and the expected refund value depending on the criteria under this law. Please use the following as Email subject: NDC ILCL – PNR/DEP DATE

3.

Note that the PNR will also be updated with this requirement following your call to IB Trade Support.

4.

If the date criteria have been applied correctly according to the law text, the refund will appear in your next BSP billing statement. If the cancellation criteria were incorrectly applied, IB Trade Support will contact you within 48hrs after your email submission.

Part 3 – Consumer Protection Law (1981) – Israel text, clause 1 and 2

1st Clause

A ticket purchased by a citizen of Israel who are protected under Israeli consumer law subject to following conditions can ask for a full refund subject to the following conditions:

1.

The ticket needs to be issued in Israel with the journey starting or passing through TLV.

2.

A separate ticket issued in conjunction with TLV route can be refunded as well. For Example: Travel agent issued ticket for TLV-LON-TLV on LY (subject to verification) and issued a separate ticket for LON-CDG-LON on BA.


If above conditions are met, the ticket may be refunded by notice in writing:

• Within fourteen days of the date of purchase (if 14th day falls on a Saturday or holiday and extra 1 day is given) or of receipt of a document containing the details listed in article 14C(b) - whichever is later; and...

• At least seven days, not being days of rest, before the date of departure. For Example:

a) If ticket was issued on 01Jan19 for travel on 17Jan19. Travel agent is calling us on 14Jan19 so in this case cancellation will be as per fare rules as we only have 3 days before departure.

b) If ticket issued on 01Feb19 for travel on 28Feb19 and travel agent is calling on 17 Feb then we will apply the above policy considering 15Feb and 16Feb (Friday and Saturday) as days of rest.


In such cases, the cancellation fee shall be equal to 5% of the price of the ticket or ILS 100, whichever is lower. Otherwise cancellation fees as per fare rule will apply.

2nd Clause

A ticket purchased in Israel by an individual who is a "disabled person", a "senior citizen" (65 years or above) or a "new immigrant" in a "long-distance sales transaction" (same as above conditions) according to the definitions of these terms as set in the Israeli Consumer Protection Law, 1981, may be cancelled by notice in writing:

1.

Within four months of the date of purchase or of receipt of a document containing the details listed in article 14C(b) - whichever is later; and...

2.

At least seven days, not being days of rest, before the date of departure.

This will apply solely on transactions which included a conversation between the dealer and the consumer (including a conversation by means of electronic communication).

In such cases, the cancellation fee shall be equal to 5% of the price of the ticket or ILS 100, whichever is lower. Otherwise cancellation fees are as per fare rule will apply.

IMPORTANT NOTE

• Note: If senior citizen or disabled person travelling with family or companion then in that case this applies only to the individual and not to the entire family / companion. Customer needs to send a valid document to confirm ‘'senior citizen'‘, ‘’disabled person’’ or ‘’new immigrant"
